Welcome to ApexVigor Health. These Terms of Service ("Terms") govern your access to and use of the website located at apexvigorhealth.com (the "Site"), as well as all associated services, features, content, and telehealth routing offered by ApexVigor Health LLC ("ApexVigor," "we," "us," or "our").

PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SITE OR SERVICES. BY ACCESSING, BROWSING, OR USING THE SITE, CREATING AN ACCOUNT, OR SUBMITTING AN ONLINE HEALTH QUESTIONNAIRE, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, YOU MUST NOT ACCESS OR USE THE SITE.

1. Medical Disclaimers & Emergency Notice

1.1 No Emergency Services

THIS SITE AND OUR SERVICES ARE NOT FOR MEDICAL EMERGENCIES. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, SEVERE CHEST PAIN, SHORTNESS OF BREATH, SUDDEN VISION LOSS, AN ERECTION LASTING LONGER THAN 4 HOURS (PRIAPISM), OR ANY OTHER ACUTE HEALTH SYMPTOM, CALL 911 IMMEDIATELY OR GO TO THE NEAREST EMERGENCY ROOM.

1.2 Healthcare Provider Relationship

ApexVigor Health LLC is a technology and administrative service platform. ApexVigor is not a medical practice, pharmacy, or licensed healthcare provider. Medical evaluations, consultations, diagnoses, and prescriptions are provided solely by independent, licensed healthcare professionals ("Providers") affiliated with third-party medical networks or partner clinics. ApexVigor does not practice medicine or interfere with the independent professional judgment of any Provider.

1.3 Informational Content

All general content on the Site, including articles, blog posts, product explanations, and marketing materials, is for informational and educational purposes only and does not constitute medical advice, diagnosis, or treatment.

2. Telehealth & Medical Consultations

2.1 Scope of Telehealth Services

Telehealth involves the delivery of healthcare services using electronic communications, information technology, or other means between a licensed Provider and a patient who are not in the same physical location. You understand and agree that:

Telehealth cannot replace all face-to-face medical visits.
The Provider determines, in their sole clinical judgment, whether telehealth is appropriate for your condition and whether you are eligible for prescription medication.
Treatment is not guaranteed, and completing an intake questionnaire does not ensure a prescription will be issued.

2.2 Accuracy of Information

You agree to provide complete, current, and truthful information during your intake questionnaire, medical evaluations, and subsequent communications. Falsifying health data, omitting symptoms, or withholding medication history (especially nitrate usage or blood pressure medications) creates severe medical risks for which ApexVigor and its affiliated Providers disclaim all liability.

3. Eligibility & Account Responsibilities

Age Limit: You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use our Site and Services.
Geographic Restrictions: Telehealth services are available only to individuals located within US states or jurisdictions where our partner Providers are duly licensed.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at info@apexvigorhealth.com of any unauthorized account use.

4. Prescriptions, Pharmacy, & Fulfillments

Prescription Decisions: All prescriptions are issued entirely at the discretion of independent licensed Providers.
Partner Pharmacies: Prescriptions are fulfilled and dispensed by independent, licensed mail-order pharmacies. ApexVigor does not manufacture, package, or directly dispense pharmaceuticals.
Medication Risks: You are responsible for carefully reading all drug information sheets, warning labels, and usage instructions provided with your medication before taking it.

5. Payments, Subscriptions, & Refund Policy

5.1 Pricing & Payment Authorization

By placing an order or subscribing to a recurring consultation/treatment plan, you authorize ApexVigor (or our third-party payment processor, e.g., Stripe) to charge your designated credit card or payment method for all applicable fees.

5.2 Subscription Renewals & Cancellation

Auto-Renewal: Subscription plans automatically renew at regular intervals (e.g., monthly or quarterly) until canceled by you.
Cancellation: You may cancel your subscription at any time prior to the next billing date via your account dashboard or by emailing info@apexvigorhealth.com.
Refunds: Due to regulatory and healthcare safety standards, prescriptions and fulfilled medications cannot be returned or refunded once shipped. Medical consultation/evaluation fees are non-refundable once the clinical review has commenced.

6. Intellectual Property Rights

All content, trademarks, service marks, logos, graphics, source code, and design elements on the Site are the exclusive property of ApexVigor Health LLC or its licensors. You are granted a limited, non-exclusive, non-transferable license to access the Site for personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

7. Prohibited Uses

You agree not to:

Use the Site for any unlawful purpose or in violation of any local, state, federal, or international law.
Impersonate another person or misrepresent your identity or medical history.
Attempt to bypass, compromise, or disable any security features, medical screening logic, or access controls on the Site.
Reverse-engineer, scrape, or extract automated data from the Site.
Use prescribed medications for non-personal use or resell/distribute medications to third parties.

8. Limitation of Liability & Disclaimers

8.1 "As-Is" Basis

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL APEXVIGOR HEALTH LLC, ITS DIRECTORS, MEMBERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, SERVICES, OR MEDICATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO APEXVIGOR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to defend, indemnify, and hold harmless ApexVigor Health LLC, its affiliates, licensed Providers, partner pharmacies, and their respective officers, members, and employees from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misrepresentation of medical information, or your illegal use of the Site/Services.

10. Governing Law & Dispute Resolution

10.1 Governing Law

These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Wyoming, without giving effect to any choice of law rules.

10.2 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, or interpretation thereof shall be resolved through final and binding arbitration in accordance with the rules of the American Arbitration Association (AAA), rather than in court.

11. Modifications & Contact Information

We reserve the right to update or modify these Terms at any time. Changes will become effective immediately upon posting to the Site with an updated "Last Updated" date. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.
